1. The Agreement

These Terms of Service form a binding agreement between you and Lit Celebration Shop Inc. They apply to every visit to the website, every enquiry and every booking for a party build, a hire item or a pack-down service. Where a written plan, a quote or a booking confirmation sets out specific details, those details become part of the agreement alongside these terms.

If there is a conflict between these terms and a signed written plan, the signed written plan prevails for the booking it covers. These terms continue to apply to everything not dealt with in that plan.

2. Definitions

In these terms, we, us and our mean Lit Celebration Shop Inc. You and client mean the person or organisation that books the services or uses the website. Services means the party styling and build work described on this website, including balloon arch builds, streamer table styling, banner wall hire, gift wrap counters, kids party packages and venue pack-down crews. Venue means the place where a build or event takes place. Written plan means the document we send that sets out measurements, colours, schedule and price.

3. Eligibility and Authority

You must be at least the age of majority in Ontario to make a booking in your own name. If you book on behalf of a company, a venue, a school or another organisation, you confirm that you have authority to accept these terms for that organisation.

If you provide information about other people, for example a guest list or a contact at a venue, you confirm that you have the right to share that information with us for the purpose of the booking.

4. Our Services

We design and build party decorations and provide related event support in Toronto and the surrounding area. The current services are balloon arch builds, streamer table styling, banner wall hire, gift wrap counters, kids party packages and venue pack-down crews. Each service is described on the services page, and that description forms part of the information we rely on when we prepare a quote.

We may decline a booking where a venue is unsafe, where a room cannot carry the structure, where access is not possible in the available window or where the request falls outside the work we are equipped to deliver. If we decline a booking, we will explain why.

Colours, materials and finishes may vary slightly between production runs. We show colour samples where possible, but a screen, a printed swatch and a finished balloon will never match exactly. We aim to keep variation small and will discuss any material change before the build.

5. Quotes and Written Plans

A quote is valid for thirty days from the date it is issued unless it states otherwise. A quote is based on the information you give us and on a site walk where one has taken place. If the room, the date, the guest count or the scope changes, we may revise the quote.

A written plan sets out the measurements, the colour choices, the build order, the install window and the price. The plan is confirmed when you sign it and pay the deposit. Until both steps are complete, a date is not held and materials are not ordered.

6. Booking and Deposits

A booking is confirmed when we receive a signed written plan and the deposit stated in the plan. The deposit secures the date and allows us to order materials and reserve crew time.

Deposits are normally a percentage of the total price and are stated clearly in the plan. The remaining balance is due before the build starts unless the plan sets a different schedule. If the deposit is not received within the period stated in the plan, the date may be released to another client.

Once materials have been cut, printed or inflated for a specific booking, some costs cannot be recovered. This is reflected in the cancellation terms below.

7. Payment Terms

Invoices are payable in Canadian dollars by the method set out in the plan. Payment is due by the date on the invoice. If an invoice is overdue, we may pause work on the booking and charge reasonable interest on the outstanding amount where the law allows.

Card payments are processed by a third party provider. We do not store full card numbers on our own systems. Receipts are issued for every payment, and a final invoice is issued at the close of the booking.

Where a booking includes hire items, the hire fee covers the stated hire period only. Late return of a hire item may attract an additional charge as set out in the plan.

8. Cancellations and Rescheduling

If you cancel a confirmed booking, the deposit is normally non refundable because it covers materials and reserved crew time. Cancellations made more than fourteen days before the build may be rescheduled once without a rescheduling fee, subject to availability. Cancellations made within fourteen days of the build may attract a charge for materials already ordered and time already blocked.

If we must cancel or move a booking for reasons within our control, we will offer a full refund of amounts paid for the unperformed part of the work, or a rescheduled date at your choice. We are not responsible for events outside our control, such as severe weather, a venue closure, a power failure or a public health order, but we will work with you to find a fair solution in those cases.

9. Venue Requirements and Site Access

The client is responsible for arranging access to the venue for the agreed install window. This includes keys, codes, a loading area, lift access and any permission required from the building owner. If access is delayed, the install may run late and we may not be able to complete every element by the event start time.

The venue must provide a safe working area, adequate light and a floor that can support the build. We may ask for written confirmation that fixings are permitted. Where fixings are not allowed, we use free standing frames with weighted bases, and we will say so in the written plan.

If a venue requires a copy of our insurance or a method statement before the build, we will provide it on request within a reasonable time.

10. Install of Balloon Arches and Streamer Tables

Balloon arches are built on frames and anchored so that the structure holds through the event. The client agrees not to move, lean on or dismantle a finished arch unless a crew member has approved the change. A moved arch may lose its shape and may become unsafe.

Streamer tables are dressed with ribbon curtains, runners and weights. The client agrees to keep sharp objects and open flame away from the ribbons and to tell us in advance if the table will be used for hot food or a candle centrepiece. Where a table is restyled after install, we cannot guarantee the finish.

We aim to complete install before the event start. A final check is made under the room lighting, and any adjustment requested at that point is made on the spot where possible.

11. Hire of Banner Walls, Counters and Related Equipment

Hire items remain the property of Lit Celebration Shop Inc. at all times. The client is responsible for the items from delivery until collection. Hire items must not be altered, painted, cut or sub let, and must be stored in a dry place away from heat and moisture.

If a hire item is lost, stolen or damaged beyond normal wear, the client agrees to pay a replacement or repair charge as stated in the plan. Normal wear from a single event is not charged. The client should tell us about any damage as soon as it is noticed so that we can assess it fairly.

Collection is arranged in the plan. If the client is not ready for collection at the agreed time, a further collection visit may be charged.

12. Client Responsibilities

The client agrees to give accurate information about the room, the date and the access arrangements. The client agrees to tell us promptly about any change that could affect the build, including a change of venue, a change of date or a change to the guest count.

The client agrees to ensure that the venue permits the work, that any required building approval has been obtained and that the area is clear when the crew arrives. The client also agrees to keep children and pets away from the working area during install and pack-down.

Where the booking includes a gift wrap counter or a pack-down crew, the client agrees to provide a safe route for staff and to follow any instruction given about access or closing time.

13. Safety and Damage

Balloons and ribbons are decorative materials and are not toys. Small pieces can present a choking risk, and foil balloons must not be released outdoors. The client agrees to dispose of any loose pieces safely and to keep them away from young children.

If the crew finds a hazard at the venue, such as a loose railing, a wet floor or an unstable ceiling, work may be paused until the hazard is resolved. We will not install a structure that we believe is unsafe.

The client is responsible for damage caused by guests or by a third party after install. We are responsible for damage caused by our crew through negligence, and we will repair or make good at our own cost in that case.

14. Photography and Portfolio Use

We photograph finished builds and the room before and after pack-down. These photographs help us confirm the condition of the room and improve our work. We may ask to use a photograph in our portfolio, on this website or on a social platform.

We will ask for permission before publishing a photograph in which a person can be identified. If you prefer that no photographs are taken, tell us before the build and we will record that instruction in the plan.

15. Intellectual Property

The designs, drawings, photographs, text and layout on this website belong to Lit Celebration Shop Inc. or are used with permission. You may view and print pages for your own use, but you may not copy, republish or sell the content without written permission.

A custom design prepared for a booking remains our design, though you are free to enjoy the finished build and to photograph it for personal use. We do not reuse a private client design for another client without consent.

16. Limitation of Liability

To the fullest extent permitted by law, Lit Celebration Shop Inc. is not liable for indirect, incidental or consequential loss, including loss of profit, loss of enjoyment or loss of a venue booking, arising from the services or the website.

Our total liability for a booking is limited to the amount paid for that booking, except where the law does not allow such a limit, for example in cases of death or personal injury caused by negligence, or in cases of fraud. Nothing in these terms excludes a right that you have under consumer protection law.

We are not responsible for a delay or failure caused by something outside our reasonable control, including severe weather, a transport failure, a venue closure or a public health order. We will tell you promptly if such an event affects your booking.

17. Indemnity

You agree to indemnify Lit Celebration Shop Inc. against reasonable losses, claims and costs that arise from your breach of these terms, from inaccurate information you provide, or from damage caused by your guests or contractors at the venue. This indemnity does not apply to loss caused by our own negligence or by our breach of these terms.

18. Privacy

Our Privacy Policy explains how we collect and use personal information. It forms part of our agreement with you and should be read together with these terms. By using the website or booking the services, you acknowledge that you have read the Privacy Policy.

If you send us information about other people, you confirm that you are allowed to do so and that those people understand how their information will be used for the event.

19. Website Use

You agree to use the website lawfully and not to interfere with its operation. You must not attempt to gain unauthorised access to any part of the site, send malicious code, scrape content at scale or use the site in a way that harms other visitors.

The website is provided as it is. We try to keep it accurate and available, but we do not promise that it will always be free of errors or interruptions. Prices and service descriptions may change, and the version on the website at the time of booking is the version that applies.

20. Suspension and Termination

We may suspend or end a booking if a client behaves abusively toward our crew, provides false information, fails to pay an invoice or refuses to follow a reasonable safety instruction. In that case, we will account for work already done and materials already ordered.

You may end the agreement at any time by contacting us, subject to the cancellation terms above. Ending the agreement does not affect any right or obligation that arose before it ended.

21. Governing Law and Disputes

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. The courts of Ontario have jurisdiction over any dispute arising from these terms or the services.

Before starting a formal claim, we ask both sides to try to resolve the matter by discussion. Most concerns can be settled quickly once the facts are clear, and we prefer to fix a problem rather than argue about it.

22. Changes to These Terms

We may update these terms from time to time to reflect a change in our services or in the law. The date at the top of the page shows when the current version took effect. If a change is material, we will take reasonable steps to bring it to the attention of clients with active bookings.

The terms that apply to a confirmed booking are the terms in force when the booking was confirmed, unless a change is required by law or you agree to the updated terms.

23. Contact

If you have a question about these terms or a booking, please contact the studio. We are happy to explain how a particular clause applies to your event.
